ASSOCIATION
SUMMERFIELD LEASING RESTRICTIONS By Michael Rome, J.D.
Many Summerfield residents
are unaware that there are leasing restrictions in the covenants. (See
Article XI of the Declaration of Covenants) Here is a summary of the major
provisions:

Prior to leasing, the owner
must provide the Board with written notice of the intended lease, which
includes the name and address of the Lessee and the terms of the proposed
lease;

All leases and lessees are subject
to the provisions of the Declaration, Bylaws, and Rules. The Owner must
make available to the tenant a copy of the Declaration;

Upon request by the Association,
the Lessee shall pay all unpaid assessments. All payments made to
the Association shall reduce by the same amount Lessee's obligation to
make monthly rental payments to Lessor under the Lease.

If Lessee fails to comply with
the Association's request to pay assessments, Lessee shall also pay all
late or delinquent charges, fines, interest, and costs of collection.

A violation by the Lessee of
any provision of the Declaration, Bylaws, Rules and Regulations shall constitute
a default under the lease; and
-
In the event the Association
proceeds to evict the Lessee, any costs associated with the eviction shall
be specifically assessed against the Lot
Owners (Landlords) and Lessees
(Tenants) are encouraged to review all of the provisions of Article XI
